Yeah, I'm uncomfortable doing it for the reasons already mentioned:

- its not done this way in similar protocols
- success/failure responses would be asymmetric (encrypted/unencrypted)
- its redundant

I'd rather go with a separate response which is enabled by the client, 
like Clive suggested.
